The case against David Bisard has made headlines for over two years.
On August 6th, 2010, Officer Bisard crashed his police cruiser into a group of bikers on 56th Street. One motorcycle rider was killed. Two others were critically injured.
Two hours later, a blood sample was taken from the officer which showed a blood-alcohol level of .19 which is more than twice the legal limit.
On August 19th, 2010, all drunken driving charges were thrown out because the blood sample was drawn at a lab not certified by the police department.
On January 12th, 2011, a new prosecutor Terry Curry re-filed the dropped DUI charges.
On October 4th, 2011, the two injured riders, Kurt Weekly and Mary Mills, filed a lawsuit against the city, the Indianapolis Metro Police Department and Officer Bisard for severe and permanent physical injuries.
On October 27th, 2011, a Marion Count judge ruled that critical evidence like Bisard's blood-alcohol level during the crash could be used in court.
On April 17th, 2012 it was revealed that the second vial of Bisard's blood was moved out of refrigeration in the property room in November 2011. (A judge ruled in favor of prosecutors' request to test a second vial of blood drawn from Officer Bisard. That's when they discovered it had been moved out of refrigeration.)
On December 6, 2012, a judge approved the change of venue request.
A few days later, on December 10, 2012, the Indiana Supreme Court ruled that a blood draw performed on Bisard on August 6, 2010, was appropriate. (Testing showed Bisard's blood-alcohol level was more than twice the legal limit. Bisard's legal team hoped to keep the blood evidence out of his trial.)
On February 14, 2013, a judge ruled that the trial would be moved from Indianapolis to Fort Wayne, citing extensive media coverage of the case.
On March 8, 2013, a trial date was set for October 15, 2013. The trial is likely to take a few weeks.
On April 27, 2013, David Bisard is arrested for driving drunk. Prosecutors charge him with two misdemeanors: Operating a Motor Vehicle While Intoxicated and Operating a Motor Vehicle with a BAC 0.15 grams or greater, both Class A Misdemeanors.
