Estranged husband now primary suspect

Noblesville - A double murder investigation moves forward this weekend with police calling one of the victim's estranged husband the "primary suspect."

Someone shot Rebecca Payne and her male companion, George Benner, inside Payne's Carmel home Thursday.

Police arrested Payne's husband, Toby, on stalking charges. Prosecutors have yet to file murder charges against him.

Family members are now making funeral plans for Rebecca Payne and her friend George Benner but as they say their final goodbyes the search for answers surrounding their deaths has just begun.

"We think we have a pretty good idea on the periphery of the puzzle, now, we have to attack the detail of the puzzle and what's in the middle," said Hamilton County Sheriff Doug Carter.

One key piece of the puzzle: Rebecca's estranged husband, Toby Payne.

Police do know the double murder was not a random act of violence.

"Mr. Payne is no longer a person of interest us, but he is a primary suspect in the double murder," said Carter.

Saturday morning around 2:15 a.m. deputy's arrested Payne at his parent's Covington home on a felony charge of stalking. He is now back in the Hamilton County jail on no bond.

An investigation into a restraining order filed by Rebecca in late February led to the stalking charge.

Sheriff Carter explained, "Through a process of search warrants, we were able to articulate in great detail conversations that Mr. Payne had with his now deceased wife.  And we are still trying to build a timeline of communication he had with his deceased wife up to and including the day of the murder."

Both Rebecca Payne and George Benner died from gunshot wounds inside the home. Each victim shot twice. The sheriff's department is not releasing any other details at this time because of the circumstances surrounding the crime.

"We are still trying to determine who if anyone else was involved, we certainly are not limiting all of our resources to one individual," Carter said.

No murder charges at this time as investigators continue to build their case, a puzzle they call "complicated and cumbersome."

They continue to ask the public to help them solve it.

Toby Payne can be held in jail for 15 days on the stalking charge, since he violated his probation out of Boone County for a previous arson conviction.

Detectives will spend the rest of the weekend sharing information and evidence.
