UPDATE: No criminal charges filed against couple who fatally shot neighbor

UPDATE 6/2/16: Prosecutors say they will not file criminal charges against an east side couple who shot and killed their neighbor.

Investigators say the husband and wife woke up to find James Neal inside their home near Bosart and Michigan Road.

During a struggle with Neal over a shotgun, police say the couple both fired multiple shots at him.

Friends of the victim say he suffered from seizures and must have been disoriented when he went in uninvited.

ORIGINAL STORY:

Police are on the scene of a home invasion in which the homeowner fatally shot the intruder in the 700 block of South Bosart Avenue near Emerson and English Avenue on Indianapolis' east side.

Police say that the homeowner shot and killed the intruder around 6 a.m. Tuesday. The man died at the scene.

Police say the family was home at the time of the incident, including at least one child.

Homicide has been called to investigate.
