Woman missing from Indianapolis since 2004 declared legally dead

Molly Dattilo went missing from Indianapolis in 2004. A judge signed an order on Wednesday at the request of her family to have her declared legally dead.

JEFFERSON COUNTY (WTHR) - A Jefferson County judge has granted a request made by the family of a girl who went missing from Indianapolis in 2004 to have her declared legally dead.

The Madison Courier reports that Circuit Court Judge Darrell Auxier signed an order Wednesday determining that Molly Dattilo is presumed to be deceased due to her continued absence of more than seven years.

Dattilo disappeared from Indianapolis on July 6, 2004. She made a call from a pay phone at a gas station in Speedway around 11 p.m. that night.

Police said they never had enough evidence to file charges in the case.

In 2010, Dattilo's family won a $3.5M judgement in a lawsuit against two men that the family claimed was responsible for her disappearance.

Dattilo was a student at Eastern Kentucky. She was taking classes at IUPUI at the time of her disappearance.
