2018 WTHR Operation Football Spirit Award Rules

Contest Description. The Operation Football Spirit Award acknowledges high school football spirit as demonstrated by submitted photo and video content, and photo and video content collected by WTHR-TV (the Sponsor). The school determined as the “most spirited” at the end of the promotional period will win the Operation Football Spirit Award.

Contest period. Contest will run from 12:01am ET Friday, 8/17/2018 until 12:01am ET Saturday, October 13, 2018.

Eligibility. This promotion is sponsored by WTHR-TV. Contest is void where prohibited. By entering, each entrant accepts and agrees to be bound by these contest rules. Employees (and their immediate family members) of WTHR-TV, our parent companies, third-party sponsors and vendors are not eligible. To enter, you must be at least 18 years old and a legal resident of one of the following central Indiana counties: Bartholomew, Benton, Blackford, Boone, Brown, Carroll, Cass, Clay, Clinton, Decatur, Delaware, Fayette, Franklin, Fountain, Grant, Hamilton, Hancock, Hendricks, Henry, Howard, Huntington, Jackson, Jay, Jennings, Johnson, Lawrence, Madison, Marion, Miami, Monroe, Montgomery, Morgan, Owen, Parke, Putnam, Randolph, Ripley, Rush, Shelby, Tippecanoe, Tipton, Union, Wabash, Warren, Wayne, Wells, or White.

How to Enter. Entrants meeting the eligibility criteria will submit photos and/or videos showcasing their school spirit via the WTHR website Spirit Award web page (www.wthr.com/spirit). Additionally, entrants may tweet or post photos and/or videos via direct message to WTHR’s social media accounts or the social media accounts of Spirit Award participating sponsors. WTHR or its sponsor(s) is/are not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsor(s)), telephonic failures, human error, or any other error or malfunction. If any submitted photo and/or video is determined to be inappropriate by the sponsor for any reason, sponsor reserves the right to consider the entry to be ineligible.

How the Prize is Awarded. At the end of the contest period, select representatives from WTHR and its sponsor will select a winning eligible entry that is deemed “most spirited” based on three categories: creativity, execution, and overall presentation. Representative of the winning entry and their respective school will notified by telephone, e-mail, mail or social media within 10 business days. If no school is determined to have achieved a sufficient level of “school spirit” based on the submissions, then no winner will be selected.

Prize. The school represented by the wining eligible entry will receive an offer to host a WTHR/WZPL pep rally and “free concert”. The timing, content, structure, execution and any logistical details will be mutually agreed upon between the sponsor and the school.

Odds of Winning. The odds of winning depend on the number of entries received.

Rights granted. Rights Granted by You: By entering this content (e.g., photo, video) You understand and agree that the sponsor, anyone acting on behalf of the sponsor, and the sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of the sponsor If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless the sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which the sponsor may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Limitation on Liability. By entering this promotion, each entrant forever discharges and releases Sponsor(s), its/their parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from any and all liability, claims, causes of action, suits, and demands of any kind arising from or in connection with the promotion, including, without limitation, responsibility for property damage, loss of life, or personal injury resulting from or in connection with participating in the promotion or from or in connection with use or receipt of the prize(s), however caused.

Sponsor's Reservation of Rights. All federal, state, and/or local rules and regulations apply. Void where prohibited by law. These official rules are subject to modification by WTHR-TV and its sponsors. WTHR-TV and its sponsors reserve the right to change or modify these rules as needed at any time during the contest. In the event of a dispute, all decisions made by the above sponsors are final and binding. Sponsor(s) reserve(s) the right, in its/their sole discretion, to disqualify any person who tampers with the entry process or the operation of Sponsor's/Sponsors' web site(s), or who otherwise acts in violation of these official rules. Sponsor(s) further reserve(s) the right, in its/their sole discretion, to cancel, terminate, or modify this promotion if, for any reason, the promotion is not capable of completion as planned, including due to infection by computer virus, technical corruption, or non-authorized human intervention that compromises or affects the administration, fairness, integrity, security, or proper conduct of the promotion.
