Man tells police he wasn't drinking while driving, says he was drinking while stopped

INDIAN COUNTY RIVER, Fla. (WTHR) — A Florida man used an interesting excuse when he was confronted by officers.

According to Treasure Coast Palm, Earle Stevens Jr., 69, is facing a DUI charge.

Authorities were called to a McDonald's drive-thru after a woman said the man in line behind her continued to hit her rear bumper.

When police questioned Stevens, they noticed he had an open bottle of liquor in his passenger seat, WBAL11 reported. He also admitted to not having a valid Florida license.

Stevens then told officers he wasn't drinking while driving, but instead taking drinks of Jim Beam while stopped at traffic lights and stop signs, WBAL11 reported.

Breathalyzer results showed he had a blood alcohol content of .153. He has two prior DUI charges in Missouri.
