Jared Fogle's attorney granted appeal extension

The attorney for former Subway spokesman Jared Fogle is asking for more time to explain why Fogle should serve a shorter prison sentence.
A judge sentenced Fogle in November to more than 15 years for possessing child pornography and other child sex crimes.

Fogle's attorney, Ronald Elberger, filed the appeal last month, but was given more time for the appeal because of Elberger's poor health.

Elberger was diagnosed with prostate cancer a year ago, and that has since spread to his lymph nodes. In the appeal, Elberger cited other medical conditions which prompted him to ask for an extension from the original due date of Jan. 25, 2016 to Feb. 19. The request was granted.

Fogle was sentenced to 15 years in prison as part of a plea deal in connection with child porn and sex crimes charges. At his sentencing in November, Fogle told the judge he'd led a life of "deception and lies."

The once-beloved Indiana native rose to fame through his Subway commercial appearances after losing weight eating their sandwiches.
