Indiana nursing home worker accused of raping 74-year-old patient with dementia

HANOVER, Ind. (WAVE) - A southern Indiana nursing assistant is accused of raping an elderly patient while he was at work.

According to WAVE-TV, certified nursing assistant David Garcia is facing felony rape charges, accused of raping a 74-year-old resident of the Hanover Nursing Center. The victim, who has dementia, told investigators she had sex with a man and pointed toward her groin.

Garcia denied having sex with the patient, explaining away evidence investigators found on a blanket in the room. The alleged assault happened December 1.

Jefferson County Prosecutor David Sutter said it's too early to say if more charges will be added, but said seeking justice for victims in these kinds of cases is very important.

"As a community, you always want to try to take care of your most vulnerable. We certainly feel like whether it's infants or folks that are for whatever reason in nursing centers, those are people that we need to take care of and we obviously take that very seriously. Community safety is the utmost importance for my office and the Hanover Police Department," Sutter said.

Garcia is being held on a $50,000 cash-only bond. If convicted, he could face up to 16 years in prison.
