SOUTH BEND, Ind. -

The South Bend City Council has approved a developer's plan to build a six-story building near downtown after a zoning board rejected his request for height variance.

Developer Dave Mathews got around the need for a variance by saying he would develop the property as a planned unit development. The South Bend Tribune reports the maximum height for such projects is seven stories, while the limit for new structures in that neighborhood is five stories.

Matthews says the $8 million development will include a maximum of 42 apartment-condo units, 9,000 square feet of office space, 8,000 square feet of restaurant space and a 3,500-square-foot public plaza.

Two neighborhood groups were divided on the issue of the new development.
