Former Muncie school principal to serve out sentence

A former Muncie high school principal convicted of failing to report a rape at his school in a timely fashion will have to serve out his sentence.

The Indiana Supreme Court today reinstated Chris Smith's conviction and 100 hours of community service.

In 2010 Smith made a 16-year-old girl wait in his office for hours after she told him she was raped in a Muncie Central High School restroom.

An appeals court overturned Smith's conviction more than a year ago, but on Thursday the high court ruled Smith "failed to protect" the student.

Justice Steven David wrote in the majority opinion that former Muncie Central Principal Christopher Smith "dawdled, delayed, and did seemingly everything he could to not contact" police and the Indiana Department of Child Services after the November 2010 incident.

Justices Robert Rucker and Brent Dickson dissented in the 3-2 decision issued Thursday, saying the state had failed to prove its case.

Smith was sentenced to 120 days in jail, all suspended to probation, ordered to serve 100 hours of community service and to pay a $100 fine and court costs.

The 16-year-old who raped the girl spent a year in prison.
