Federal judge blocks new chemical abortion law

Updated:
INDIANAPOLIS -

A federal judge is blocking new limits state lawmakers placed on a Lafayette Planned Parenthood clinic earlier this year.

Republican lawmakers passed a set of rules earlier this year mandating that clinics which perform chemical abortions meet the same standards as those that perform surgical abortions. But U.S. District Court Judge Jane Magnus-Stinson blocked the start of the new law Tuesday while she considers a challenge filed by the American Civil Liberties Union of Indiana.

The law would effectively shut down the only abortion clinic in Lafayette by requiring it add things like a recovery room and surgical equipment. Lawyers for the ACLU argued the state law violates the Constitution's equal protection clause, while lawyers for the state argued the law is a valid product of the General Assembly.
