Mother says custody dispute isn't over gay rights

The mother of a 5-year-old boy who is at the center of a high-profile custody battle says she knows that it looks like she is fighting against gay rights, but says she is not.

Nicole Jasinski tells the South Bend Tribune that her focus is on doing what is right for her son, not setting legal precedent. The case has drawn statewide attention because it led the Indiana Court of Appeals has asked the Legislature to update state laws to address custody issues regarding children of same-sex families.

Court records show Jasinski became pregnant with donor sperm, and she, Amber Carpenter and the boy lived as a family in Elkhart, even though Carpenter never formally adopted him.

The appeals court ruled that Carpenter could ask for visitation.
