Prosecutor: Murder charge may have to be dropped in baby death

INDIANAPOLIS -

An Indiana prosecutor acknowledges he may have to drop a murder charge against a Chinese immigrant who ate rat poison while she was pregnant since a judge ruled a doctor's claim that the toxin killed her newborn baby can't be used at trial.
 
Marion County Prosecutor Terry Curry said Friday that prosecutors are considering dismissing the murder charge against Bei Bei Shuai following the decision.
 
Curry says prosecutors could appeal the ruling or find another pathologist to assess the cause of Angel Shuai's death. He says Shuai still could be prosecuted for attempted feticide.
 
Judge Sheila Carlisle ruled last week that the doctor who performed the autopsy on the baby didn't consider other possible causes of death, including a drug administered to Shuai in the hospital.
