According to the U.S. Centers for Disease Control (CDC), tainted steroid injections produced by Massachusetts-based NECC have been linked to 656 cases of fungal meningitis and other fungal infections in 19 states. The case count includes 39 deaths as a result of fungal meningitis. NECC recalled all of its products and voluntarily surrendered its license to operate on October 6, 2012. Prior to the recall, the potentially tainted steroids were shipped to 76 facilities in 23 states, the CDC said.

According to The New York Times, subsequent investigation of NECC found extensive contamination at its facility, as well as a long history of questionable practices that had drawn warnings from the state and the Food & Drug Administration. The laws proposed by Gov. Patrick would, among other things, establish strict licensing requirements for compounding sterile drugs, and allow the state to fine facilities that violate rules. The new laws would also provide whistleblower protection to people who work for compounding pharmacies, and reorganize the state’s pharmacy board so that it includes fewer members who are a part of the industry, the Times said.
