INDIANAPOLIS -

The Indiana Supreme Court has let stand a ruling saying blood drawn from an allegedly intoxicated Indianapolis police officer after a fatal crash was taken properly, but his attorney says it's not certain yet the evidence will be allowed at trial.

The high court Monday let stand an Indiana Court of Appeals ruling. Marion County Prosecutor Terry Curry says that means the sample can be used to support drunken driving and criminal recklessness charges against Officer David Bisard.

Bisard attorney John Kautzman says he still can challenge the sample during the trial for other reasons, and a jury might not find it credible.

The sample showed Bisard's blood-alcohol level more than twice the legal limit at the time of the crash that killed Eric Wells and injured two other motorcyclists.
