Judge: federal agent used "reasonable force" in shooting death

A judge has ruled that a deputized federal agent used reasonable force when he shot and killed an Illinois man after officers pulled him over near an Indiana highway.

Federal judge Philip Simon said in Thursday's ruling that Drug Enforcement Administration agent Jeremy Ogden likely feared he was in "imminent danger" from Rosalio Rincon when he shot him. Simon ruled against Rincon's relatives' request for damages in their suit against the federal government.

The Post-Tribune reports law enforcement officials pulled over Rincon near U.S. 30 and Interstate 65 in September 2007 following a drug deal.

Rincon's family argues Ogden shot Rincon as he hit the gas in order to drive off. But prosecutors say Ogden fired because he believed Rincon intended to drive his car into the agent.
