INDIANAPOLIS -

A Marion County Sheriff's Department deputy is on leave, pending an investigation into a fatal accident.

Deputy Erich Gephart, 41, was involved in the accident on the ramp to Interstate 65 southbound from 29th Street around 9 p.m. Sunday. Gephart was driving a Sheriff's arrestee transportation wagon and was on duty when investigators say he struck and killed 31-year-old Adam McCarty, who was standing next to a truck that had run out of gas.

Police say McCarty was attempting to add fuel to the truck and was in the roadway without emergency lights or flashers operating on the truck. His driver's license had been suspended last December.

Gephart was required to submit a blood sample, per Indiana law. He was placed on administrative leave, pending investigation into the crash.
