Indiana appeals court denies bid to avert trial

INDIANAPOLIS -

The Indiana Court of Appeals says the state's former top utility regulator must stand trial on four official misconduct charges.

A three-judge panel on Friday refused to take jurisdiction of David Lott Hardy's case to consider the constitutionality of the charges and his health condition.

Hardy's doctor stated in court documents that the former Indiana Utility Regulatory Commission chairman suffers from fatigue and has received clinical treatment including blood transfusions for severe anemia.

Hardy was indicted in December on charges he allowed the top lawyer for regulatory commission to continue overseeing cases involving Duke Energy when the attorney was trying to get a job there. Hardy's lawyers have argued the charges are too broad and seek to impose criminal liability for violating administrative rules.

A trial date hasn't been set.
