Pacers owner Simon wants suit heard by Indiana court

INDIANAPOLIS -

Indiana Pacers owner Herb Simon wants the Indiana Supreme Court to hear a defamation lawsuit he and his wife have filed against a California attorney.

Indiana's highest court will hear oral arguments October 24 on whether a state appeals court ruled correctly in favor of attorney Joseph A. Davis in dismissing the lawsuit.

Simon and his wife, Bui, contend Davis defamed them over the firing of a nanny at their California home. Davis represents the nanny.

The nanny's lawsuit seeking back wages was dismissed by a California judge.
