Bar asks to be dismissed from suit in girl's death

A Lafayette bar has asked a Tippecanoe County judge to dismiss it from a lawsuit filed by the parents of a 15-year-old girl killed when she was struck by a car while walking on the shoulder of a road.

The Journal & Courier reports Jerry Knight and Wanda McCaulley are seeking compensatory and punitive damages from Hop's Shawnee Tavern and Champs Sports Bar, the two places they contend 42-year-old Robert Kirts II drank before hitting Ebony Knight two years ago.

The lawsuit contends Hop's and Champs knowingly served alcohol to an "intoxicated person" and "habitual drunkard."

Hop's is seeking to be dismissed from the lawsuit, saying Kirts was at the bar at midafternoon and the bar closed two hours before the accident.
