No charges in Don's Guns fatal shooting

INDIANAPOLIS -

The clerk shot at Don's Guns a week ago remains hospitalized in serious condition.

Benjamin Chance was working at the store on the west side of Indianapolis when he was shot in the chest by a customer. Chance returned fire, killing Brian Wayner.

Chance's sister tells Eyewitness News he will undergo surgery Thursday.

Police say Wayner was a former college student from Indianapolis. He had rented a gun and fired ammunition in the store's shooting range before opening fire on the clerk.

Wayner had no criminal record.

Police say the clerk was justified in shooting back and will not face charges. The prosecutor's office later confirmed that no charges will be filed.
