Pizza delivery man shooting suspect resists tests

BLOOMINGTON -

A judge says a public defender risks jeopardizing his own case if he continues to advise a man charged with killing a Bloomington pizza delivery driver not to cooperate with mental health experts.

Twenty-three-year-old James David Finney claims he was insane when he killed Adam Sarnecki last November, but public defender Michael Spencer asked a judge in June to cancel scheduled psychological exams because he claims Finney was unprepared to participate.

The Herald-Times reports Monroe Circuit Judge Marc Kellams told Spencer during a pretrial hearing Tuesday that sanctions can be imposed barring evidence from defense experts if he continues to advise Finney to not cooperate.

Spencer refused to say why he doesn't want Finney to cooperate. 

Kellams also postponed Finney's murder trial from Oct. 1 to Feb. 18.
