Judge rejects Velvet Underground copyright claim on banana

NEW YORK -

A judge in New York has dropped a claim by The Velvet Underground over the banana image used on the band's debut album cover. Federal Judge Alison Nathan eliminated a copyright claim but left in place trademark claims.

The Velvet Underground sued the Andy Warhol Foundation, claiming the foundation should not have licensed the design for use on iPhones and iPads. An attorney for the band says they disagree with the ruling and they believe they will win the trademark claims.

A Warhol foundation lawyer declined comment.
