AP Source: Ex-Sachs programmer charged again

Posted: Updated:
NEW YORK -

Six months after getting a federal conviction overturned, a computer programmer is being charged again with illegally using valuable trading software from Goldman Sachs.

Sergey Aleynikov was due to be arraigned Thursday in Manhattan - this time on state charges.

Defense lawyer Kevin Marino says Aleynikov will fight the new charges vigorously.

A person familiar with the case says Aleynikov will face a state charge of unlawful use of secret scientific material, based on allegations similar to the federal case. The person spoke on condition of anonymity because the charges had yet to be made public.

The Russian-born Aleynikov was freed from prison in February after an appeals court said a federal law used to convict him was misinterpreted. He had been serving a more than eight-year sentence.
