Mother files lawsuit in fatal Kroger shooting

INDIANAPOLIS -

A woman has filed a wrongful death lawsuit against a supermarket where her son was shot and killed.

Jeremi Atkinson, 26, was shot by a Kroger store manager after police say he tried to rob the store near 71st and Georgetown in late December. Prosecutors say the manager was justified under Indiana law, but he violated company policy.

Eyewitness News obtained a copy of the lawsuit which claims, "By failing to supervise its employees, enforce its own policies, and failing to properly train its employees, Kroger breached its duty of care to Atkinson."

A Kroger spokesman tells us it has not been notified of the lawsuit and won't comment.

Manager Elijah Elliott shot Atkinson, who later died.

Elliott says he was not pressured to resign, even though Kroger has a policy that doesn't allow employees to have concealed weapons on the job.
