Indiana conviction upheld despite lapsed law license

INDIANAPOLIS -

The Indiana Court of Appeals has ruled that a man sentenced to 20 years in prison for a 2009 jail escape isn't entitled to have his conviction set aside even though the prosecutor who handled his case had a lapsed law license.

Fifty-four-year-old James Daher Jr. of Indianapolis had argued he was improperly convicted and sentenced because former Newton County Prosecutor Ed Barce had put his law license on "inactive status" in 2005 before becoming full-time prosecutor.

Barce reactivated his license in February 2009 but he was reprimanded by the Indiana Supreme Court for the unauthorized practice of law.

The Times of Munster reports that the appeals court upheld Daher's conviction in a 3-0 decision Friday, ruling that Barce was prosecutor in fact, even if not in law.
