Prosecutor: Fort Wayne police shooting justified

A prosecutor says a Fort Wayne police officer was justified in fatally shooting a man who fired at authorities, wounding a federal marshal, while trying to flee from an apartment.

The Journal Gazette reports Allen County Prosecutor Karen Richards declined to press charges against Officer Derrick Demorest in the April shooting of 26-year-old Marcus Hayden.

Police said authorities knocked on the apartment door and tried to talk to Hayden. They forced their way in when he didn't respond. Hayden started firing and wounded a marshal in the leg. Hayden then jumped out a window and was shot after refusing to follow orders to drop his gun.

Hayden was wanted for a probation violation.
