Group files suit over Indianapolis smoking ban

INDIANAPOLIS -

A group of smokers and bar owners filed a lawsuit Wednesday saying the city's smoking ban is unconstitutional.

An attorney representing 43 plaintiffs says the smoking ban infringes on the rights of bar owners and patrons.

"Americans have a choice. That's one thing we have in this country is the freedom to choose, and if it's freedom to make the wrong choice, that happens," said Mark Small, attorney.

The attorney pointed out the framers of the constitution convened over mugs of ale and pipes of tobacco in 1787.
