Indiana: Right-to-work lawsuit can't be amended

HAMMOND -

The state says a union challenging Indiana's new right-to-work law should not be allowed to file an amended complaint on the issue.

It argues in a motion filed Tuesday that most of the claims are the same as those in the original federal lawsuit filed in February.

The motion filed by Attorney General Greg Zoeller also argues a motion by International Union of Operating Engineers Local 150 to amend the lawsuit should be denied because the case is futile. The filing argues that a federal court is barred by the 11th Amendment from hearing claims to compel a state official to conform conduct to state law.

A message seeking comment from Local 150 attorney Dale Pierson was left Tuesday afternoon at his office by The Associated Press.
