INDIANAPOLIS -

An IMPD officer already facing possible termination now faces charges of drunken driving.

Officer Matthew Elam, 42, was arrested for driving under the influence on the south side of Indianapolis two weeks ago. A worker at the Steak 'n Shake restaurant on Southport Crossings Drive on the south side alerted officers inside the restaurant of a driver passed out behind the wheel of his truck at the drive-thru window. After putting Elam's truck in park, they ordered him out of the vehicle, detecting an odor of alcohol.

The officers reported that Elam staggered to the back of his vehicle, where he refused sobriety tests. After obtaining a search warrant, Elam was taken to Wishard Hospital for a blood draw. He faces a misdemeanor charge of operating a vehicle while intoxicated.

Elam is already in front of IMPD's merit board for a July 2010 crash. In that case, Elam is accused of wrecking his squad car and covering up the repairs without telling IMPD supervisors. A grand jury in that case indicted him for failure to stop and official misconduct.

The officer was recommended for termination following the 2010 crash, but the merit board has yet to rule on that case. Elam's status with the department remains "pending termination without pay."
