Christopher Smith's 120-day sentence was suspended. He was ordered to pay a $100 fine for the misdemeanor as well as put in 100 hours of community service. He will also spend 120 days on probation. Smith could have faced up to six months in prison.
The investigation began in November 2010 when a 16-year-old female student was raped in a school bathroom. Police said the student sat in the principal's office for more than two hours while the alleged attacker was allowed to leave the school. The girl had to write down her version of what happened, even though Muncie Police officers were working in the school as security.
Steven B. Moore, a former Muncie Central student who was 16 at the time, was charged and convicted in the rape. He was sentenced to four years in prison in 2011.
The case angered many parents, who said Smith should have done what the law requires: to report the suspected abuse in a timely manner. As it turned out, police said they lost valuable evidence when Smith allowed the suspect, Moore, to go home and wash his clothing.
In fact, police were only alerted to the incident when Child Protective Services arrived at the school.
Smith was removed from his position although he was still employed by the school district as of 2011.
No other school officials were charged in the case.
