Child killed in north side accident

INDIANAPOLIS -

Police are investigating an accident that killed a seven-year-old girl on her birthday.

The crash happened just before 8 a.m. at the intersection of Binford Boulevard and Delmar Road on the north side of Indianapolis. Investigators say 35-year-old Erick Avery was crossing Binford eastbound on Delmar when his vehicle was struck by two northbound vehicles.

Seven-year-old Eries Avery was found unconscious in the front seat of the vehicle by emergency crews. Her four-year-old brother had a broken leg in the back seat.

"Unfortunately, the seven-year-old was transported, where she was later pronounced deceased. Her brother was being treated at Riley, as well, and the dad went to Wishard with non-life-threatening injuries," said IMPD Ofc. Kendale Adams.

Investigators are unsure if either child was wearing a seat belt, but told Eyewitness News they did not find any type of child seat in the car.

The drivers of the other vehicles involved were not hurt. It is not known at this time if charges will be filed in the case.

"If it doesn't look clear, don't go. Just be patient and wait," Adams said.

A road sign at the intersection reads "right turn only."
