Indiana court orders bond for baby death suspect

INDIANAPOLIS -

The Indiana Court of Appeals says bond can be granted to an Indianapolis woman accused of killing her premature baby by ingesting rat poison while she was pregnant.

The court on Wednesday reversed a lower court ruling denying bond for Chinese immigrant Bei Bei Shuai. The court says the defense presented sufficient evidence to rebut the presumption that Shuai is guilty and it has ordered a Marion County judge to set bond.

But the three-judge panel rejected Shuai's argument that the murder and feticide charges against her should be dismissed. The court says hasn't proven common-law immunity exists for pregnant women who harm their own fetuses.

Shuai's attorney says the Chinese immigrant ate rat poison because she intended to kill herself, not her baby.
