INDIANAPOLIS - Two more people are planning to sue the state because of the State Fair tragedy. The attorney general now says 53 people want to share in Indiana's $5 million Tort Claim Fund.
A regulatory risk analyst with Wells Fargo and a ten-year-old Kentucky girl are the latest to make claims against the state. Both suffered head injuries when the stage scaffolding fell at the Indiana State Fair before the Sugarland concert Aug. 13th.
Catherine Huegen, a 41-year-old mother of two, traveled from southern Illinois for front row seats to the Sugarland concert. Her attorney says she was knocked down and struck in the back of the head by one of the poles from the collapsed stage.
Ten-year-old Jade Walcott's injuries were even more severe. She was in a medically induced coma for three weeks and underwent brain surgery and a second surgery to replace part of her skull.
Both are now seeking financial payments from the state under the system set up by Ken Feinberg, who has set up victim compensation funds for the 9/11 and Virginia Tech Victim's memorial fund.
Those wishing to make a claim must file paperwork with the attorney general by November 1st to be eligible. The funds will be distributed sometime after that.
