INDIANAPOLIS - The state attorney general says he's asking a court to dismiss a lawsuit involving the Indiana State Fair stage collapse.

Attorney General Greg Zoeller says the attorneys for Angela Fischer failed to file a tort claim ahead of the lawsuit. The law requires a tort claim to be filed first, and the state then has 90 days to approve or deny it. If a claim is denied, the claimant may file a lawsuit against the state.

Now Zoeller wants a court to dismiss the suit until the proper process can be completed.

So far, Zoeller's office has received tort claims from six people in connection with the stage collapse. Zoeller says the other five claimants followed the correct procedure.

"This is not a reflection on the plaintiff's claim, but there are deadlines and a process that must be followed under Indiana law. We can't have one claimant try to cut in line when other claimants are following the rules," Zoeller said.

The Indiana attorney general's office represents the state of Indiana in various legal matters related to the Indiana State Fair incident. The attorney general's office also administers the Indiana Tort Claim Fund.
