Woman outraged over husband's rape sentence
A woman who was raped at home is outraged over her attacker's punishment. The attacker is her husband, David Wise, who raped his wife while she was sleeping. But his punishment does not include even a day in jail.
A judge handed down a 20-year sentence Friday for David Wise. He'll serve eight of those years on home detention, but the other 12 are suspended.
A jury found Wise guilty last month of rape and criminal deviate conduct.
The victim, Many Boardman, says she is very upset with the sentence Wise received.
"I feel like I got sucker punched in the gut Friday when my rapist, my convicted rapist, was given a home detention sentence," said Boardman. "I heard the judge tell me to forgive my rapist and then I listen to him say he can go home that day. Never in a million years would I have thought anyone would ever, especially a judge, I never thought anyone would ever tell me to forgive my rapist and I mean, in a million years, thought my rapist would be walking out the door with me."
"This isn't one of those situations where you can say wrong place wrong time. There is no other place to be than with your family, at home asleep, next to your husband, believing you are safe," said Courtney Curtis, Marion County deputy prosecutor.
Boardman says she found videos on Wise's cell phone showing him raping her after he had drugged her. "This man was a repeat offender. This was not a one-time thing. It happened for three years. He admitted to drugging me in open court," she said.
"There is no difference when a woman knows her attacker and when she doesn't," said Curtis. "I think it is important to remember that this crime is one that was committed in the home and so serving a home sentence in the home is not something this office would ever ask for."
"I don't see how forgiveness is an option here," Boardman added.
Marion County Superior Court Judge Kurt Eisgruber handed down the verdict last Friday. Wise was also stripped of visitation rights for the couple's two children. He served 24 days in jail.
