Suit can proceed against Madison County Prosecutor

A federal judge has ruled that a man whose murder conviction was overturned can proceed with his lawsuit against a central Indiana prosecutor.

Walter Goudy spent 15 years in prison for a 1992 murder before a federal appeals court ordered his release. He's seeking millions of dollars in damages against Madison County Prosecutor Rodney Cummings.

The Herald Bulletin reports  Goudy's suit alleges Cummings and investigator Steve Napier withheld important evidence during Goudy's trial.

Cummings and his attorneys filed a motion in April, asking a federal judge to dismiss the case. That judge issued a decision Monday granting part of that motion and rejecting another part.

The ruling means Cummings and Napier will act alone as defendants. The judge's ruling also threw out Goudy's claim of malicious prosecution.
