Special prosecutor to hear case against marshal

A special prosecutor has been appointed to hear allegations of excessive force and harassment against a south-central Indiana town marshal.

The Republic reports a Bartholomew County judge appointed Jennings County Prosecutor Alan Marshall to hear the case against Elizabethtown Town Marshal Tom Nienaber. Bartholomew County's prosecutor had recused himself from that case.

Nineteen-year-old Issac McGuire alleges that Nienaber committed two instances of wrongful behavior during two separate medical emergencies at his family's home.

McGuire says Nienaber grabbed him under the arms, leaving behind marks, after the teen yelled an obscenity while standing with a relative March 18 during the second of those emergencies. McGuire says he was distraught when he yelled the obscenity.

Nienaber says McGuire exaggerated the facts. He says his actions toward McGuire were warranted.
