Prosecutors await blood test results in fatal Madison County crash

Prosecutors in Madison County looking to file charges against an Edgewood Police officer are on hold right now waiting on his blood work.

Suspended Edgewood Officer James Foutch was arrested Sunday in the fatal crash. Investigators say Foutch-rear ended the car of Jesse Sperry and his pregnant wife Rebecca on State Road 32.

Jesse Sperry died on the scene. Paramedics rushed his wife to St. Vincent Hospital for an emergency delivery of their baby girl, Autumn.

Investigators suspect Foutch was impaired from taking hydrocodone.

Prosecutor Rodney Cummings says they are waiting his blood work results to file charges. But Cummings says the state crime lab is backlogged ten months.

Cummings is now seeking a rush on the officer's blood work, he says, to keep the wheels of justice turning in a timely fashion and more importantly so his officers can provide better information to the victim's family.

Foutch is on administrative leave from the police department after posting bail to get out of jail.
