A Marion County sheriff's deputy was involved in a fatal crash Sunday night while driving a Sheriff's Department vehicle.

It happened around 9:00 pm on the ramp to southbound I-65 from 29th Street. According to police, Deputy Erich Gephart, 41, was driving the arestee transportation wagon when he struck and killed Adam McCarty, 31. McCarty's 1983 Ford F150 had run out of gas and McCarty was on the roadway holding a gasoline container, attempting to add fuel to the truck.

According to the report, the stalled truck had no lights or flashers on, and there were no flares, reflective triangles or other safety devices to warn other drivers.

McCarty's Indiana Motor Vehicle Operator License was suspended indefinitely on December 24, 2011.

The Indianapolis Metropolitan Police Department (IMPD) investigated the crash.

Deputy Gephart was transported to Wishard Memorial Hospital to submit a blood specimen for examination, as required by Indiana law and departmental policy.

Police say there was no indication that Deputy Gephart was under the influence of alcohol and/or drugs. He was placed on administrative leave pending the outcome of the investigation.
