Jeffersonville woman gets two-day sentence, serves 5 months
A southern Indiana woman who spent five months in a local jail despite being sentenced to only two days behind bars is now weighing a possible civil suit against county officials.
A special judge released 34-year-old Destiny Hoffman on Thursday from the Clark County Jail after a local prosecutor discovered the oversight.
The Jeffersonville woman is a participant of the county's drug court treatment program and she was sentenced to 48 hours in jail for a program violation.
The News and Tribune reports the judge who sentenced Hoffman ordered her "held until further order of the court." But he never issued that order, resulting in her 154-day incarceration.
Hoffman's attorney, Nathan Masingo, says he may file a civil suit against Clark County alleging his client was unlawfully incarcerated.
