Indiana judge's links to project backers questioned

Some legal experts say an Indiana Supreme Court justice should recuse himself from an upcoming case over a proposed $2.8 billion coal-gasification plant in southern Indiana.

Justice Mark Massa is a longtime friend of Mark Lubbers, who represents developers of the planned Rockport plant. Massa also was a top aide to former Gov. Mitch Daniels when Daniels was promoting the project.

Massa has shown no signs of stepping aside before the court in September hears appeals over the state's role in the project, and Eyewitness News partners at The Indianapolis Star report a court spokeswoman says he can't comment on a pending case.

Lubbers says neither he nor anyone else with the plant developer has talked with Massa about the project.

State legislators have ordered regulators to consider new ratepayer protections.
