Court reinstates lawsuit filed by Boston's Tom Scholz

The Massachusetts Appeals Court has reinstated a defamation lawsuit filed by Tom Scholz of Boston against the ex-wife of late singer Brad Delp.

Scholz had claimed Micki Delp had made remarks to the Boston Herald that could be construed that Scholz was to blame for Brad Delp's suicide in 2007. The article said Brad Delp was upset after a longtime member of Boston was dropped from a summer tour and that Delp was still upset about Boston's breakup more than 20 years earlier.

A lower court had ruled that Scholz had failed to prove Micki Delp acted with malice in her comments to the Herald. The appeals court ruled a jury should decide if there was malice. A separate lawsuit against the Herald was thrown out in March.
