Carmel bus assault victim's attorney wants federal investigation

Hamilton County - The lawyer for a Carmel boy who says he was attacked on a basketball team school bus plans to push for a federal investigation.

Attorney Robert Turner told Eyewitness News the grand jury indictments just don't fit the alleged crimes.

"This just doesn't pass the smell test with me," Turner said.

A grand jury indicted four seniors and Turner argues the indictments just don't fit the alleged crimes. He told the Indianapolis Star the misdemeanor charges are too light and those charged should face felony charges.

"I want to see the transcript, I want to see the video and if I feel there has been improper conduct here, I will ask the feds to look at this," Turner said.

Oscar Falodun and Brandon Hoge, both 18, and 19-year-old Robert Kitzinger face misdemeanor battery and criminal recklessness charges. Scott Laskowski, 19, faces three misdemeanor counts of criminal recklessness.

The charges are from alleged attacks on younger players on a school bus and repeated locker room attacks. Turner represents a 14-year-old victim.

"They are victimizing him again, saying we are attacking them because Carmel is an affluent city," Turner said.

The boy's parents talked about their son being sexually victimized by his teammates. Turner wants proof the grand jury heard it all.

"Saying that nothing happened there and that there was no conversations about sexual activity in the grand jury proceedings, etcetera, and I just don't believe that," Turner said.

Turner believes making the Carmel High School case a federal case could not only shed light on what happened to his client but also possibly bring forth more victims.

"They are supposed to look out for the rights of victims. I do not think that has happened here," Turner said.

Carmel police had suggested criminal deviate conduct and sexual battery charges during their investigation. Hamilton County Prosecutor Sonia Leerkamp said on the phone Tuesday that a response from her office will come sometime next week.
