Appeals court overturns child molestation conviction

The Indiana Court of Appeals has overturned a Marion County man's conviction for child molesting.

The court ordered a new trial because of prosecutorial misconduct during Brandon Brummett's first trial. Last year, he was convicted of abusing two relatives. He appealed, claiming that a series of comments by the prosecutor made a fair trial impossible.

The appeals judges agreed, noting the prosecutor made disparaging remarks about the defense counsel and defense attorneys in general. The prosecutor also inappropriately vouched for state witnesses and the judges said the prosecutor asked argumentative and inflammatory questions.
