Man seeks new trial due to alleged jury tampering

Updated:

Indianapolis - The Indiana Supreme Court will decide whether a LaPorte County man should get a new murder trial because a judge didn't investigate allegations of jury tampering.

The high court will hear arguments in the case Tuesday.

Chawknee Caruthers was convicted of the September 2007 shooting of Karim Turner and sentenced to 95 years for murder and being a habitual offender, but the state Court of Appeals overturned his conviction in July.

The trial judge noted during sentencing that some jurors had expressed security concerns to the bailiff due to Caruthers and his family members.

The high court will weigh whether the judge erred when she did not question the jurors to determine if they could remain impartial even though she took extra security measures.
